Artrekker Terms & Conditions
These terms govern your use of Artrekker. The same text appears inside the app under Settings > Terms.
1. Eligibility
You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement. If you are a parent or guardian permitting a user under 18 to use the App, you accept responsibility for their use.
2. Account Registration
To access certain features, you must create an account. You agree to:
• Provide accurate and complete information during registration.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.
3. Licence to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.
You may not:
• Copy, modify, or distribute the App or its content.
• Reverse engineer or attempt to extract the source code.
• Use the App for any unlawful or unauthorised purpose.
• Interfere with or disrupt the App's infrastructure or security.
4. In-App Purchases
The App may offer in-app purchases. All purchases are:
• Final and non-refundable, except as required by applicable law.
• Processed through the Apple App Store, subject to Apple's payment terms.
5. User-Generated Content
If the App allows you to submit, upload, or share content (“User Content”), you retain ownership of that content but grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute it in connection with the Services.
There is ZERO TOLERANCE for objectionable content or abusive users. By using the App you agree not to submit content that is:
• Objectionable, obscene, offensive, hateful, or pornographic.
• Harassing, bullying, threatening, or abusive toward other users.
• Illegal, harmful, or defamatory.
• Infringing on any third-party intellectual property rights.
• Containing viruses or malicious code.
6. Location and Camera Features
Certain features of the App require access to your device's location and/or camera. By granting these permissions, you consent to the collection and use of this data as described in our Privacy Policy. You may revoke these permissions at any time through your device settings, though this may limit app functionality.
7. Third-Party Services and Links
The App may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is at your own risk.
8. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Artrekker and are protected by applicable intellectual property laws. You may not use our branding or content without our prior written consent.
9. Disclaimers
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that:
• The App will be uninterrupted, error-free, or secure.
• Any defects or errors will be corrected.
• The App or its servers are free of viruses or harmful components.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Artrekker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
Where liability cannot be excluded by law (including in the UK and EU), our liability is limited to the amount you paid to us, if any, in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
For users in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may also apply and take precedence.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the “Last updated” date and, where appropriate, by sending a notification through the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the App at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may stop using the App and delete your account at any time via Settings > Account > Delete Account.
